Suspect threatens deputies, waves gun before being shot and killed

DURHAM, Calif. - A subject was shot and killed by a Butte County Sheriff's Office deputy after officers attempted to serve warrants for his arrest in Butte County Tuesday night. According to the Butte County Sheriff's Office, the man was shot and killed after he exited a residence and pointed a gun at law enforcement on the 1900 block of Durham-Dayton Highway in Durham.

The man was wanted for charges relating to an illegal marijuana grow. When deputies tried to make contact with him Tuesday, he reportedly began calling for the sheriff's office, making threats.

"The subject was growing marijuana out of compliance with the county ordinance and code enforcement served him with some paperwork yesterday," said Megan McMann with the Butte County Sheriff's Office. "He became very upset and started calling and making threats and that's when the sheriff's office was notified."

The Butte County Sheriff's Office SWAT team came to the area around 5:00 p.m. but at that point they couldn't establish communication. SWAT then planned to utilize a bomb squad robot.

"We were attempting to get the bomb squad robot to the scene to try to establish communication. Before the robot could be deployed, the subject left his residence, walked outside holding a handgun," said McMann. "Preliminary information we received is he then walked into the road and pointed the gun towards our deputies that were in the area. One of our deputies fired a single shot and hit the subject."

The subject was pronounced dead at the scene by medical personnel.

"We really wanted to establish communication, we had a lot of resources here to try and establish communication with the subject and we were hoping to have a peaceful outcome out of this," said McMann.

The highway near the scene was shut down from Lott Rd. to Jones Ave. as the investigation continued.

The man's identity has not been released.

The Butte County Officer Involved Shooting and Critical Incident Protocol Team has been activated and is investigating the incident.
